Welcome to 44 Vision. We appreciate your trust and the opportunity to serve your business. These Terms of Service (“Terms”) govern your access to and use of 44 Vision’s products, services, websites, and software. By purchasing, subscribing to, or using any 44 Vision service, you agree to these Terms.
1. Services Provided
44 Vision (“we,” “our,” or “us”) provides the following services to clients (“you” or “the client”):
Template and Custom Websites
44 Vision Digital (SaaS powered by GoHighLevel)
Search Engine Optimization (SEO)
Meta (Facebook/Instagram) Ads
Google Ads
Hosting, domain management, and ongoing maintenance
We work closely with each client to understand goals, design preferences, and marketing needs.
2. Payments and Fees
A setup fee is required before any project or service begins. Setup fees are non-refundable.
Monthly subscription fees apply to ongoing services such as 44 Vision Digital, hosting, SEO, and advertising management.
All subscriptions renew automatically each month unless canceled in accordance with Section 6.
A 30-day money-back guarantee applies to monthly subscription service fees only (not setup or design fees).
Payments are automatically processed through the client’s authorized payment method.
If payment fails or becomes overdue, 44 Vision may suspend or terminate service until payment is received.
3. Client Responsibilities
Clients are responsible for providing:
Domain access or the domain name to be used
Company logo, photos, videos, and creative assets
Content and accurate business information during onboarding
If a client does not respond or provide required materials within 30 days, the account or project may be automatically canceled and any setup fees will be forfeited.
4. Ownership and Licensing
Custom Websites: Upon full and final payment, the client owns the completed website content and design.
Template & SaaS Websites (44 Vision Digital): Clients receive access for as long as their subscription remains active. Access stops if the subscription is canceled or unpaid.
Software License: Clients receive a limited, non-transferable, non-exclusive license to use 44 Vision Digital and its associated software only for their own business operations.
All proprietary software, tools, frameworks, and methods remain the property of 44 Vision.
5. Confidentiality and Proprietary Information
Both parties agree to keep confidential all proprietary information exchanged during the course of services, including but not limited to marketing strategies, client data, pricing, processes, and account credentials.
This information will not be shared or used outside the scope of the business relationship, except as required by law.
6. Cancellation and Termination
Clients may cancel at any time by sending a written notice to [email protected] at least 30 days before the next billing date.
If the client fails to pay or respond within 30 days, services may be terminated automatically.
Once canceled, access to 44 Vision Digital or hosted services will stop at the end of the billing cycle.
Refunds are not issued for setup fees or completed work.
7. Additional Services
Any service requested outside the scope of an existing plan or project will be billed at $200 per hour, unless a separate written agreement or package price is approved by both parties in advance.
8. Limitation of Liability
44 Vision will not be liable for any incidental, consequential, indirect, or special damages, including lost profits, resulting from performance or nonperformance of services.
In all cases, 44 Vision’s total liability shall not exceed the total amount paid by the client for the service in question.
9. Dispute Resolution
Any disputes or claims arising from this agreement shall be governed by the laws of the State of Wyoming.
Clients agree not to reverse or dispute credit card charges after the refund period has expired. If a client initiates a chargeback for services already performed, 44 Vision reserves the right to pursue the balance owed, including recovery of costs associated with defending the chargeback.
10. No Guarantee of Results
44 Vision does not guarantee any specific marketing or sales results. While we use proven strategies, results vary depending on factors outside our control (e.g., competition, budget, platform algorithms, market behavior).
11. Communications
All communication is handled via email and scheduled phone calls.

Our typical response time is within 24–48 hours (excluding weekends and holidays).
Office hours are 9 AM – 7 PM PST.
12. Portfolio Release
The client grants 44 Vision permission to display completed work and non-sensitive materials in its portfolio, website, or marketing materials (such as Facebook, Instagram, or other platforms).
If the client wishes to restrict this, they must notify 44 Vision in writing.
13. Privacy & Data Policy
44 Vision values client and user privacy.
Information collected through onboarding, forms, or the 44 Vision Digital platform is used solely for service delivery and performance tracking.
44 Vision may collect user data such as names, emails, and business details to operate CRM, automation, and communication tools.
Data is stored securely and not sold or shared with third parties, except trusted vendors essential for providing the service (e.g., hosting or payment processors).
Clients are responsible for ensuring they have proper consent from their contacts and customers before storing or messaging them through the platform.
44 Vision complies with applicable privacy and data protection laws to the best of its ability.
14. Modification of Terms
44 Vision reserves the right to modify these Terms at any time. Updated versions will be posted on our website or sent via email. Continued use of our services after notice of changes constitutes acceptance of the updated Terms.
15. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full effect.
16. Acceptance of Terms
By purchasing, subscribing to, or using any 44 Vision service, the client acknowledges that they have read, understood, and agreed to these Terms of Service.
